SB 940

Housing Crisis Act of 2019: City of San Jose.Ch. 201, Stats. 2020 · chaptered 2020-09-28 · Later amended

Key provisions · Claude summary of the digest, not bill text

Allowed the City of San Jose to upzone proactively and later use that added capacity to downzone eligible parcels without a net loss of residential capacity, until its 6th cycle housing element was due.

  • Capacity banking. Authorized San Jose to change zoning to a more intensive use and use the added capacity to later change zoning on an eligible parcel to a less intensive use, with no net loss in residential capacity.
  • One-year window. Required the less intensive change to occur within one year of the more intensive change.
  • Reporting. Required San Jose to report each downzoning on a website by its effective date and in its annual report, and to send the annual report to relevant legislative policy committees.
  • Sunset. Made the authority inoperative on the date San Jose's 6th cycle housing element update is due.

Preamble

SECTION 1. The intent of the Legislature in enacting this act is to locate housing within the urban growth boundary close to transit and services and not to reduce housing capacity in the City of San Jose.

SEC. 2In the navigator:§ 66300changes

Section 66300 of the Government Code is amended to read:

SEC. 3

The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because the City of San Jose has unique open space land that will be negatively affected without the ability to change a zoning ordinance to a less intensive use as described in this measure.
