Housing.Ch. 48, Stats. 2018 · chaptered 2018-06-27 · Later amended

Key provisions · Claude summary of the digest, not bill text

Housing budget trailer bill that refined SB 35 streamlining standards, added a CEQA exemption for financing streamlined affordable projects, and created several homelessness funding programs, including the $500,000,000 Homeless Emergency Aid program; took effect immediately.

  • SB 35 production trigger. Required the production report to show fewer building permits for both above moderate-income units and units for households at 80% of area median income than needed to meet RHNA for the below market rate trigger.
  • SB 35 flood standards. Barred sites in FEMA special flood hazard areas (1% annual chance flood) unless subject to a letter of map revision or meeting FEMA floodplain criteria, and sites in regulatory floodways without a no-rise certification; prohibited denial for failing additional local site requirements when federal criteria are met.
  • Skilled workforce. Exempted units that are 100% subsidized affordable housing from the skilled and trained workforce requirement for projects over 50 units (approved 2020–2021) or over 25 units (approved 2022–2025).
  • CEQA financing exemption. Exempted from CEQA state or local financial assistance to streamlined developments for very low, low-, or moderate-income housing.
  • Homeless Emergency Aid. Created a one-time $500,000,000 block grant program administered by the Business, Consumer Services, and Housing Agency, requiring a shelter crisis declaration (unless waived), 50% obligation by January 1, 2020, and 100% by June 30, 2021.
  • Building Homes and Jobs funds. Allocated $5,000,000 each to the Bridges at Kraemer Place shelter in Orange County and a County of Merced navigation center, with remaining homelessness funds split between the new California Emergency Solutions and Housing Program and Housing for a Healthy California.
  • Emergency Solutions and Housing. Established the California Emergency Solutions and Housing Program, allocating funds by Continuum of Care service area under 5-year contracts, with unspent funds reverting to the Multifamily Housing Program.
  • Other changes. Until January 1, 2024, revised migrant farm labor center residency rules and required annual reporting; expanded the Homeless Coordinating and Financing Council to up to 17 members staffed by the Business, Consumer Services, and Housing Agency.
